Abstract

The paper gives a comparative example of conventional and Islamic family law, their principles, usage, and implications in modern societies. Family law, which forms a major pillar of social organization, regulates important elements of marriage, divorce, inheritance, and child custody. Conventional laws on family are mostly based on secular law systems that focus on individual rights, equality between the genders, and the changing social norms. However, Islamic family law based on Sharia is founded on religious values and moral duties and collective harmony and tends to focus on family cohesion and gender roles. This study shows areas of convergence, like the protection of the rights of children, and divergences, such as the ways of divorce and inheritance, by comparing and contrasting them. The paper also examines issues of balancing such systems in pluralistic societies. In a final conclusion, the paper highlights the importance of dialogue and contextualizing adaptation so as to strike the right balance between tradition, religion, and modern laws on governance of family issues.
