Abstract

In an era marked by armed conflicts, socio-political unrest, and recurrent humanitarian crises, the principle of impartiality has become a cornerstone of contemporary humanitarian practice. International humanitarian institutions—such as the Red Cross and Red Crescent Movement—emphasize assistance based solely on human need, irrespective of color, race, gender, ideology, religion or any other affiliation. without discrimination on the basis of race, religion, ideology, or political affiliation. This article examines the concept of impartial humanitarian action through the normative and ethical lens of Islamic law. Drawing upon the Qur’ān, Prophetic traditions, the practice of the Rightly Guided Caliphs, and classical juristic discourse, the study demonstrates that Islam establishes a robust moral framework that not only recognizes universal human dignity but also mandates non-discriminatory benevolence toward all individuals, including non-Muslims, adversaries, and vulnerable populations. Through textual analysis and historical case studies—such as the Prophet’s(S.A.W) assistance to needy non-Muslims and the equitable treatment of prisoners—the research highlights that impartiality is deeply embedded in Islamic humanitarian ethics. The article further explores points of convergence and divergence between modern humanitarian principles and Islamic jurisprudence, identifying areas where Islamic norms offer supplementary moral grounding or expanded ethical obligations. The findings suggest that Islamic legal and ethical teachings provide strong support for impartial humanitarian engagement and can contribute meaningfully to contemporary humanitarian discourse. The study concludes with policy-oriented recommendations aimed at enhancing the effectiveness, neutrality, and inclusivity of humanitarian operations in Muslim-majority contexts.
