Family structure serves as the cornerstone of human society, yet contemporary socio-economic transformations have led to a noticeable rise in domestic conflicts and matrimonial disputes. While modern legal frameworks offer various dispute resolution mechanisms, addressing family issues within Muslim societies requires a delicate balance between divine Shariah principles and contemporary legal realities. Key issues such as divorce, Khul‘, waiting period (‘Iddah), child custody, and financial maintenance often present complex legal, ethical, and social challenges that demand comprehensive scholarly examination. This study employs a qualitative and analytical research methodology to investigate contemporary family disputes and their Shariah-based settlements. It explores the juristic foundations and procedural mechanisms governing marriage dissolution—specifically divorce and Khul‘—alongside its post-dissolution consequences including ‘Iddah, child custody, and financial maintenance. Furthermore, the research critically evaluates current legal practices, contemporary Muslim family laws, and judicial trends to determine the extent to which modern settlements align with authentic Islamic jurisprudence.
The findings reveal that Islamic law provides a balanced, humane, and comprehensive framework for resolving matrimonial disputes, ensuring the protection of fundamental rights, human dignity, and the best interests of vulnerable parties, particularly women and children. The study concludes that many prevailing complications in family dispute resolutions stem from procedural delays, social stigmas, and cultural misinterpretations rather than Shariah principles themselves. The research highlights the necessity of reforming judicial mechanisms and promoting institutionalized reconciliation to ensure swift, equitable, and Shariah-compliant settlements in modern Muslim societies.
