The formation of early Islamic jurisprudence was significantly shaped by the distinct juristic methodologies developed in the historical academic centers of Madinah and Kufah. While the Madinan scholars (Aṣḥāb al-Ḥadīth) relied primarily on textual traditions, prophetic precedents, and the practice of the people of Madinah (‘Amal Ahl al-Madīnah), the Kufan scholars (Aṣḥāb al-Ra'y) extensively employed legal reasoning, analogy (Qiyās), and juristic preference (Istiḥsān) to address complex legal scenarios. In the contemporary era, as Muslim societies face unprecedented socio-economic, medical, and technological challenges, re-examining these classical methodologies becomes imperative for developing balanced and dynamic legal solutions.
This study employs a qualitative, comparative, and analytical research methodology to investigate the Ijtihadic approaches of the Madinan and Kufan schools of law. It explores the foundational principles governing textual inference, the weight assigned to solitary traditions (Āḥād), and the divergence in analytical deduction between textualist and rationalist frameworks. Furthermore, the research evaluates the applied relevance of these classical methodologies in addressing modern legal problems, assessing how integrating text-based preservation with context-driven legal reasoning can inform contemporary Islamic lawmaking.
The findings reveal that the methodological divergence between the scholars of Madinah and Kufah reflects a complementary intellectual richness within Islamic jurisprudence rather than a fundamental contradiction. The study concludes that classical Ijtihadic frameworks possess inherent flexibility and offer vital methodological tools for contemporary legal reasoning. By harmonizing the textual fidelity of Madinah with the analytical adaptability of Kufah, modern Muslim scholars can formulate balanced fatwas and statutory reforms capable of addressing complex contemporary issues while remaining firmly rooted in Shariah principles.
